1. Agreement to Terms

By accessing or using Saga Reads ("the Service"), operated by Fog City Creations LLC ("we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Saga Reads is a personal book tracking application that allows users to manage their reading libraries, track progress through book series, import reading data, and interact with an AI reading assistant. The Service is provided "as is" and may be updated, modified, or discontinued at any time.

Feature descriptions on our website, in the App Store, and within the app describe the Service as it exists at the time of publication and are not a commitment to provide any particular feature for any particular period. We may add, change, limit, suspend, or remove features — including features available only to paying subscribers — at any time. Some features depend on data supplied by third parties (see Section 6) or on third-party AI providers (see Section 7), and may change or become unavailable if those providers change, restrict, or discontinue their services.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep your account information up to date.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Upload or transmit viruses or other malicious code
• Use automated systems to access the Service in a manner that exceeds reasonable use

5. User Content

You retain ownership of content you create within the Service, such as book reviews, notes, and ratings. By submitting content, you grant us a limited license to store, display, and process that content as necessary to operate the Service. We do not claim ownership of your personal reading data.

6. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Fog City Creations LLC and protected by applicable intellectual property laws. Book metadata, cover images, and descriptions are sourced from third-party providers (Open Library, Google Books, ISBNdb, and the Internet Speculative Fiction Database) and are subject to their respective licenses. ISFDB data is used under the Creative Commons Attribution 4.0 (CC BY 4.0) license and has been modified and adapted for use in Saga Reads. Full attribution for all data sources is on our Credits page.

7. AI Features

The Service includes an AI reading assistant ("Sage") powered by third-party AI models. AI responses are generated algorithmically and may not always be accurate. We do not guarantee the accuracy, completeness, or usefulness of AI-generated content, including book recommendations and reading suggestions.

Access to AI features is subject to fair-use limits — including limits on the number of messages, the length of conversations, and total usage over a billing period — which vary by plan and by the underlying AI provider's capacity and cost. Current limits are shown in the app when you approach them, and AI access remains subject to Section 4 (Acceptable Use). We may introduce, adjust, or remove these limits at any time, and may change the underlying AI models or providers without notice.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Fog City Creations LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising out of or relating to your use of the Service.

10. Termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, for conduct that we determine violates these Terms or is harmful to the Service or other users. You may delete your account at any time through the Service settings.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by updating the "Last updated" date at the top of this page. For changes that materially affect an active paid subscription, we will also give notice in the app or by email before the change takes effect for you, and the change will apply from your next billing period. Continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Subscriptions and Auto-Renewal

Saga Reads offers an optional premium subscription, Saga Pro, which unlocks additional features. Saga Pro is sold as an auto-renewable in-app purchase and is billed through your Apple App Store account. What Saga Pro includes is described in the app at the time you subscribe and may change over time — see "Features included with Saga Pro" below. The following terms apply to all Saga Pro subscriptions:

• Plans and pricing. Saga Pro is available as a monthly plan (US$4.99 per month) or an annual plan (US$49.99 per year). Prices are shown in U.S. dollars; actual prices may vary by region and are displayed in the App Store at the time of purchase.
• Auto-renewal. Your subscription automatically renews for the same period unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period, at the price of the plan you selected.
• Payment. Payment is charged to your Apple ID account upon confirmation of purchase.
• Managing your subscription. You can manage your subscription or turn off auto-renewal at any time in your App Store account settings. Deleting the app does not cancel your subscription.
• Changes to what is included. The set of features included in Saga Pro is not fixed and may change over time. We may add, change, replace, limit, or remove Saga Pro features at any time, including during an active subscription period — for example to introduce new capabilities, to retire features that few readers use, to adjust usage limits on AI features (see Section 7), or where a third-party data or AI provider changes or withdraws its service. Features of the Service that are currently available to all users at no cost may in the future be offered only as part of Saga Pro, and features currently included in Saga Pro may be made available to all users. Before we restrict access to a feature you are actively using at no cost, we will give you reasonable advance notice where required by law. Your subscription is a subscription to Saga Pro as it exists from time to time, not to any specific feature.
• If Saga Pro changes materially. If we remove or materially reduce a Saga Pro feature you are actively using, we will give notice in the app or by email. You may cancel your subscription at any time in your App Store account settings, and you may request a refund for the unused portion directly from Apple. Because all Saga Pro purchases are processed by Apple, refunds are handled by Apple under its refund policy and are at Apple's discretion; we cannot issue refunds for in-app purchases ourselves.

Subscriptions are processed by Apple and are also governed by the Apple Standard End User License Agreement and our Privacy Policy. We may change subscription pricing from time to time; any change will apply only to future billing periods and, where required by law, only after notice to you.

13. Apple App Store Terms

If you downloaded the app from the Apple App Store, the following additional terms apply and take precedence over any conflicting terms in this Agreement:

• This Agreement is between you and Fog City Creations LLC only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
• Apple has no obligation to furnish any maintenance or support services for the Service.
• In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Service to you, if any; to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the Service, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be our sole responsibility.
• Apple is not responsible for addressing any claims by you or any third party relating to the Service or your possession and/or use of it, including but not limited to: (i) product liability claims; (ii) any claim that the Service fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
• Apple is not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the Service or your possession and use of it infringes that third party's intellectual property rights.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• If you have any questions, complaints, or claims regarding the Service, you may contact us as described in Section 14.
• Apple, and Apple's subsidiaries, are third-party beneficiaries of this Agreement, and upon your acceptance of this Agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary of it.
